On April 8, 2026, the Government issued Resolution No. 15/2026/NQ-CP on the temporary suspension of enforcement and adjustment of the effective timeline for Decree No. 46/2026/NĐ-CP dated January 26, 2026, and Resolution No. 66.13/2026/NQ-CP dated January 27, 2026, in order to remove difficulties for food production and business activities.
1. Content of the Suspension
According to the Resolution, the Government decided:
- To temporarily suspend the enforcement of:
- Decree No. 46/2026/NĐ-CP dated January 26, 2026
- Resolution No. 66.13/2026/NQ-CP dated January 27, 2026
- Suspension period: until the end of April 15, 2026
- Reinstatement date: from April 16, 2026
These two documents are important regulations guiding the implementation of the Law on Food Safety, including several changes related to food product declaration and registration.
2. Applicable Regulations During the Suspension Period
During the period when the above documents are not in effect, the Government stipulates:
- Continued application of Decree No. 15/2018/NĐ-CP and relevant guiding documents
This is to ensure that food production, business, and import activities are not disrupted during the transitional period.
3. Reasons for the Suspension
The suspension is based on the following considerations:
- Additional time is needed to prepare for synchronized implementation
- To avoid congestion of goods and disruption of supply chains
- To support enterprises in adapting to new regulations
Previously, many businesses and associations had reported difficulties when Decree 46 expanded the scope of inspections and increased procedural requirements and compliance costs.
